01Purpose and scope

These terms of service apply to assignments entrusted to FMLP MANAGEMENT, Société par actions simplifiée à associé unique (SASU) with a share capital of 2 000,00 €, RCS Nanterre 107 953 804 (immatriculée le 24/07/2026), registered office at 17 allée de l'Arlequin, 92000 Nanterre, by players or clubs.

They are provided to any client on request and handed over before any contract is signed. In the event of any inconsistency, the contract signed with the client prevails over these terms.

02Legal framework and sports agent contract

The sports agent activity is carried out personally by Mr Mahamadou Malick Diangana, sports agent licensed by the French Football Federation. FMLP MANAGEMENT is the company he set up to practise his profession. This activity is governed by Articles L. 222-5 to L. 222-22 of the French Sports Code and by the French Football Federation’s Sports Agents Regulations in force.

No introduction takes place before a written sports agent contract is signed. This contract specifies in particular: the nature of the services and whether they are exclusive; its term and its start and end dates; the amount of the remuneration and the party paying it; where applicable, the tax and social security consequences for the other party; and the obligation to notify the federation.

The agent acts, in law and in fact, on behalf of only one of the parties to a given transaction.

03Term, form and filing with the Federation

  • The sports agent contract is concluded for a fixed term not exceeding two years. It cannot be renewed tacitly: any extension requires a new written agreement signed by the parties.
  • It is drawn up in three signed copies. The agent sends one to the French Football Federation through the FFF sports agents portal within one month of signature, together with any amendment, modification or termination document.
  • The client provides the agent with a copy of any contract concluded through the agent, in time for this obligation to be met. The agent’s name appears on any contract concluded through the agent.

04Remuneration

The agent’s remuneration is set in the sports agent contract. It may not exceed 10% of the amount of the contract concluded by the parties brought together (Article L. 222-17 of the French Sports Code), this cap being an overall cap where several agents are involved, or any lower cap set by the federation. It is paid by the client who entrusted the assignment; where the client is a player, it may be paid in whole or in part by the club under a tripartite agreement complying with the same article.

No sum is requested from the client before the sports agent contract is signed, and no remuneration is paid before this contract has been filed with the Federation. Where the price cannot be determined in advance, the calculation method or a detailed quote is provided on request.

05360° support and partner professionals

Assignments to coordinate the player’s support (image, performance, nutrition, wealth organisation, etc.) are subject to a quote or written agreement specifying their content and price.

For areas falling within a regulated profession (law, tax, wealth management, etc.), services are provided by duly authorised professionals, under their own responsibility and under a separate agreement concluded directly with the client. FMLP MANAGEMENT does not practise these professions. On request, FMLP MANAGEMENT provides information on its partnerships related to the service concerned and on the measures taken to avoid conflicts of interest (Article R. 111-3 of the French Consumer Code).

06Invoicing and payment

Amounts due are invoiced and payable on the date shown on the invoice. Prices are stated exclusive of tax for business clients and inclusive of all taxes for consumers.

For business clients, any late payment automatically incurs late-payment penalties at the rate provided for in Article L. 441-10 of the French Commercial Code, payable from the day after the due date shown on the invoice, together with a fixed recovery fee of €40 (Article D. 441-5 of the same code).

07Under-18 players

In accordance with Article L. 222-5 of the French Sports Code, no consideration, remuneration, compensation or benefit of any kind is received in respect of a contract concerning an under-18 player. This rule applies whatever the term of the contract, even if the player comes of age during its performance. The contract is signed by the legal guardian(s), and no step is taken without their prior written consent.

08Right of withdrawal (consumer clients)

  • Where the client is a consumer within the meaning of the preliminary article of the French Consumer Code and the contract is concluded at a distance or off-premises, the client has fourteen days to withdraw without giving any reason. This period runs from the day the contract is concluded.
  • To withdraw, the client sends FMLP MANAGEMENT, 17 allée de l'Arlequin, 92000 Nanterre or agent@fmlp-management.fr, before the deadline, the standard withdrawal form attached to the contract or any other unambiguous statement.
  • If the client expressly requests that the assignment begin before the end of this period, the client acknowledges losing the right of withdrawal once the service has been fully performed. If the client withdraws after performance has begun, an amount proportionate to the service provided up to that decision is payable (Article L. 221-25 of the French Consumer Code). A contract signed off-premises is handed over dated and signed, together with the standard withdrawal form.

09Commitments of the parties and confidentiality

The agent keeps the client regularly informed of the steps taken and offers received, defends the client’s interests alone and complies with the applicable professional rules. The client provides accurate and complete information and informs the agent of anything likely to affect the assignment.

Information exchanged (sporting, contractual, medical or financial) is confidential and is only disclosed to a third party with the client’s consent or where required by law. The client is informed that the sports agent contract, its amendments and the required documents (including the player’s identity document) are sent to the French Football Federation, which may publish the list of contracts in force.

10End of the contract

The sports agent contract ends at its expiry date, without tacit renewal. The conditions for early termination are set out in the contract, in compliance with the applicable laws and regulations; any termination document is sent to the French Football Federation.

11Personal data

Data needed for the assignment is processed in accordance with the privacy policy.

12Complaints and mediation

Any complaint must be sent in writing to FMLP MANAGEMENT, 17 allée de l'Arlequin, 92000 Nanterre or agent@fmlp-management.fr.

Consumer mediator: membership in progress. Their contact details will be given here as soon as the agreement is signed.

13Governing law and disputes

These terms and the contracts concluded are governed by French law. The parties may seek an amicable solution, without this step or mediation being a mandatory prerequisite for consumers (Article L. 612-4 of the French Consumer Code). The dispute may be brought before the court having jurisdiction under the ordinary rules; between professionals who are traders, jurisdiction lies with the courts of the place of FMLP MANAGEMENT’s registered office.
